Complaints by Filipino workers against their placement agency (Philippine and Hong Kong) may be addressed through conciliation-mediation. This mechanism enables the parties to arrive at an amicable settlement.

   

Procedure

STEP 1 Fill up complaint form available at OWWA office.
STEP 2 Wait for your turn to be interviewed by the Labour Officer and advised of the shcedule of concillation meeting wiht HK agency
STEP 3 Come back on the appointed date and time of conciliation meeting before the Conciliator-Mediator of POLO.
STEP 4 If an amicable settlement is arrived at by the complainant and placement agency, a settlement agreement is to be executed. If conciliation failed, the complaint will be endorsed by POLO-HK to POEA for appropriate action.

 

OEC Form (download)

ONLY VACATIONING Overseas Filipino Workers (OFWs) or those presently working with existing employment contracts can obtain Overseas Employment Certificate (OEC) thereby exempting them from paying Philippine travel tax and airport terminal fees in the Philippines.

Residents or dependents of residents who are employed in HK should secure a Certificate of Residency/Dependency and apply for a Travel Tax Exemption or Reduced Travel Tax before PCG

The OEC is only valid for sixty (60) days from the date of issuance

Procedure for Issuance of OEC

STEP 1

Obtain an OFW Information Sheet from the designated OEC booth and fill up the necessary information.

STEP 2

Return to the same processing counter. Submit accomplished OFW Information Sheet and pay HK$20.00 

STEP 3

Check the correctness of entries written in the OEC, make sure that you have 4 copies before leaving the counter:

1 copy – for the airline

1 copy – for the Labor Assistance Center (LAC) Counter

1 copy – for the Terminal Fee Counter (located at the Airport)

1 copy – to be presented to the Immigration Counter (OFW’s copy)

 

NOTE: Validity of OEC is indicated in all copies, lower left side of portion. All vacationing workers who were issued exit clearance or OEC at POLO-HK are cleared for deployment and should not need to present documents required under POEA 2007 package of reforms such as the TESDA NC2 for HSWs or OWWA Certificate of Orientation/Competency on Language and Culture at the airport.

Procedure

STEP 1 Proceed to Counter 15 and wait for your turn
STEP 2 Submit the required/supporting documents and wait for office inspection to be scheduled by POLO staff.
STEP 3 After inspection, wait for call/advice for personal interview with the Labor Attache
STEP 4 Wait for the result of the interview. If approved, return to the same processing counter to claim segregated/chopped documents. If disapproved, claim the submitted documents.
STEP 5 For the approved application, proceed to notarial counter for computation of fees and issuance of official receipt
STEP 6 Pay at the Cashier’s booth and return pink slip to the notarial counter
STEP 7 Come back on the date stamped on the receipt to claim the processed documents
  • INDIVIDUAL PROCESSING

This service is extended to overseas Filipino workers (OFWs) who are renewing their employment visas, or transferring to a new employer after the old contract has expired or prematurely terminated with ID 522 from HK Immigration.

The verification process basically ensures that the contract is in compliance with labor and immigration laws of Hong Kong.

For OFWs renewing (with the same employer) their contracts, the procedure of processing their employment contract shall be under “EXPRESS EMPLOYMENT CONTRACT PROCESSING” as follows:

  1. Secure OFW Information Sheet from the Consulate guard (DOWNLOADABLE FORM). Fill up completely the Information Sheet. [FORM A]

  2. Attach completely filled-up OFW Information Sheet to the New Employment Contract and other required and/or supporting documents.

  3. Give the above-mentioned documents to the Cashier together with the exact amount of HK$297.50 as processing fee. Get only the Original Receipt (OR-white).

  4. Bring the O. R. after 5 working days to COUNTER 13 for the release of the employment contract and other documents.

NOTE: The applicant will receive a call within 24 hours upon submission of contract from POLO staff if there is any concern/problem to address it.

Those OFWs transferring to a new employer after finishing the former contract can process directly at Counter 17, while those with pre-terminated contracts must secure an ID 522 at the HK Immigration Department before they can process their new contract over-the-counter in the Consulate

  • PROCESSING THRU EMPLOYMENT AGENCY

Placement agencies shall process employment contracts of domestic helpers through “”File Easy”, the procedure of which is as follows:

  1. Submit all the employment contracts and supporting documents of domestic helpers together with the transmittal form and tally sheet to Counter 15.
  2. Upon receipt of filled up transmittal form and tally sheet from POLO staff, proceed to Cashier for the corresponding payment/s. In case there is/are questions in the submitted contracts, Agency concerned will receive a call from POLO staff within 24 hours upon submission to address the problem.
  3. Claim the processed employment contract/s from Counter 13, 5 working days after payment/submission of complete requirements.

The Philippine Overseas Labor Office (POLO) today announced that endorsement for exemption from the ban on direct hiring of HSWs will be limited only to employers covered under the following categories:

  1. Members of the diplomatic corps;

  2. Members of International Organizations;

  3. Immediate members of the family of heads of state/government;

  4. Ministers, deputy ministers and other senior officials of the host country; and

  5. Employers residing in countries where foreign agencies do not operate.
